The Institute for Reporters` Freedom and Safety regrets that the Nasimi District Court failed to fulfill the lawsuit of journalist Elmin Badalov against the university and Rector Siyavush Garayev to consider his dismissal from the Azerbaijan State Oil Academy unfounded.
On 12 November 2009 Polygon Information Agency editor E.Badalov published an article (“Reportage from Azerbaijan State Oil Academy”) on pia.az website regarding bribe cases and financial frauds in the Azerbaijan State Oil Academy. The student-journalist claimed that he faced pressure because of this article, and his failures were related to his article. On 19 January, 2010 Elmin Badalov was dismissed from the Azerbaijan State Oil Academy. He claimed that he failed because of injustice against him and appealed to court to consider his dismissal from the university unfounded. Yesterday, 5 April, the Nasimi District Court adopted a decision to not fulfill the lawsuit.
IRFS recalls that the subjection of student-journalist Elmin Badalov to harassment because of his articles contradicts article 47 (everyone has right to freedom of expression and speech) of the Constitution of the Republic of Azerbaijan and article 10 (freedom of expression) of the European Convention on the Defense of Human Rights and Fundamental Freedoms.
IRFS believes that Elmin Badalov was subjected to pressure for freely expressing his thoughts and calls on higher court instances to annul this decision.
