Today, under the chairmanship of Yasamal District Court Judge Ragib Gurbanov, a court hearing took place on the lawsuit against Baku State University Director Abel Maharramli for inactivity in response to an information request.
The lawsuit was put forth by "Bizim Yol" Newspaper correspondent Natig Abilov. Abilov and his lawyer Nurlana Aliyeva participated in the hearing. At the beginning of the hearing the judge announced that the defendant's lawyer Tofig Sadigov submitted an application to the court stating that he won't be able to participate in the hearing, and that it is ok to conduct the hearing without his participation.
Natig Adilov said that he sent the inquiry on 30 November but never received a response. "Abel Maharramov told press that he replied to the inquiry, but the letter didn't reach its destination because the address of the newspaper’s editorial office changed. But I want to make it clear that the sending date of the letter is shown as 12 December in the letter and in the receipt the opposite side presented during the preliminary hearing. However the editorial office changed its address on 27 December. Even after 27 December I talked to a person by the name of Ilgar who still lives there and he confirmed that no letter ever came to that address." The journalist and his lawyer stated that they were suspicious about the sending of the letter and petitioned that to clear things up Royale (Roya) Najafova, an authorized representative of "Azerpost and Press Secretary of Baku State University should be invited to the hearing. The judge didn't fulfill the petitions saying that they didn't conform to court claims.
The judge then went for deliberations and adopted a decision not to fulfill the lawsuit.
Natig Adilov told the Institute for Reporters' Freedom and Safety that he will appeal the decision.
Recall that on 29 November 2007 Adilov sent an information request to Baku State University about how Roya Najafova (Roya Aykhan) was admitted to the university. However the inquiry went unanswered. Adilov demands that the court adopt a decision forcing the university to answer the questions of the inquiry in detail, and also adopt a special decision about A. Maharramov under the article 265.1 of the Civil Procedural Code of Azerbaijan.
