JUSTICE MINISTRY REFUSES TO REREGISTER EMC

The Justice Ministry has refused to register Election Monitoring Center. According to a press release the Institute for Reporters’ Freedom and Safety received, on 11 August 2008 EMC founders appealed to the Justice Ministry to register the organization again.

On 3 November the Justice Ministry returned the documents submitted for the registration of EMC back. The reason shown is that the documents do not meet the requirements of the legislation.
Recall that The Justice Ministry Legal Persons Registration Department appealed to Khatai District Court under article 59 of the Civil Code asking the court to invalidate EMC's registration and cease the NGO's operations on these grounds; that the organization gave incorrect information about its founders and legal address and opened eight branches (offices) in Azerbaijani regions without informing the Justice Ministry. On 14 May 2008 Khatai District Court Judge Tofig Pashayev fulfilled the lawsuit of the Justice Ministry and issued a decision to invalidate EMC's registration and cease the NGO's operations. An appeal had been filed against this decision. On 25 November 2008 a court hearing will be held on this case in the Baku Appellate Court under the Chairmanship of Judge Isa Ismayilov.
