Today Sabail District Court denied the lawsuit of Radio Liberty correspondent Khadija Ismayilova against Yeni Azerbaycan newspaper and its chief editor Hikmat Babaoglu.
The decision was made by presiding judge Nuraddin Bagirov.
Headlined ”Khadija Ismayilova: the way she looks and the way she is”, the story in question was published in Yeni Azerbaijan newspaper on March 13 and 20, 2012. Ismayilova lodged state-run newspaper in the court alleging the article was defamatory and “not based on facts”. She requested the court to order Yeni Azerbaijan to publish correction and pay 2,000 AZN for damages.
Agshin Humbetov, deputy chief editor of the newspaper, said that the articles were based on “facts published by other mass media outlets” and asked the court to deny the claim.
After a deliberation the judge denied the action.
On March 7th secret photos about the personal life of journalist Khadija Ismayilova were posted to Ismayilova herself and her family members. A few days later her intimate videotape was broadcast on a fake website. Ismayilova is being intimidated and blackmailed for her journalistic investigations.
