MEMBER OF PARLIAMENT INSISTS ON ARREST OF JOURNALISTS

Academic Jalal Aliyev filed an appeal regarding the rejection of his special format lawsuit against Yeni Musavat newspaper’s first deputy editor-in-chiefs Azer Aykhan and newspaper’s reporter Goshgar Bakili in the Nizami District Court. The Institute for Reporters` Freedom and Safety was told this by Azer Aykhan.

According to Azer Aykhan, in the appeal Jalal Aliyev requested that the decision adopted by the Nizami District Court regarding the refusal of hearing for prosecution of A.Aykhan and G.Bakili under articles 147.1,147.2, and 148 of the Criminal Code be annulled, that the special format lawsuit be accepted for consideration, and to issue a new decision to fulfill his appeal regarding the trial.
The lawsuit stems from an article published in Yeni Musavat about J.Aliyev on 5 January. J.Aliyev filed a lawsuit in the special format under articles 147 (defamation) and 148 (insult) of the Criminal Code claiming that the information in the article “The owner of the hotel about which the President was not happy identified; ‘Baku’ hotel’s owner is J.Aliyev” was degrading to his honor and dignity and does not conform to reality.
On 10 February, 2010 Nizami District Court Judge Ziya Aliyev said that the lawsuit was not prepared in accordance with demands of legislation and issued a decision to not accept it for consideration.
MPJalal Aliyev is the brother of late President Heydar Aliyev and the uncle of the incumbent President Ilham Aliyev.
Yeni Musavat newspaper has been published since 1992 and operates as daily newspaper and has large circulation.
