PRELIMINARY HEARING HELD ON ANS LAWSUIT AGAINST “YENI MUSAVAT” NEWSPAPER

Today, 9 September, in the Nizami District court, under the chairmanship of Judge Ziya Aliyev, a preliminary hearing was held on the lawsuit of ANS television channel against “Yeni Musavat” newspaper in the civil format. “Yeni Musavat” newspaper lawyer Vagif Huseyn told this to the Institute for Reporters’ Freedom and Safety.

According to V.Huseyn, during the preliminary hearing ANS Head Director Yashar Babayev filed a new lawsuit against “Yeni Musavat” newspaper. In the lawsuit Y.Babayev stated that as a physical person he suffered moral damages as a result of articles in question written by Zahid Safaroglu and demanded that “Yeni Musavat” newspaper pay 50 000 AZN and Zahid Safaroglu pay 30 000 AZN in compensation – 80 000 (eighty thousand) AZN total.  
V.Huseyn said that he told the court that the newspaper has already published an apology and a refutation stating that the author made a mistake, and asked the court to grant him some time to submit evidence on the case.
The judge scheduled the next hearing on this case for 29 September at 2:00 p.m.
Recall that ANS TV appealed to court because of an article published on 27 August in “Yeni Musavat” newspaper stating that ANS TV channel advertises vodka. “Yeni Musavat” newspaper published a refutation, but filed a lawsuit in the Sabail District Court claiming that ANS TV used offensive language against the newspaper in its information that was disseminated in connection with the article. In the lawsuit ANS TV is asked to pay 100 000 (hundred thousand) AZN.
