STUDENT JOURNALIST’S LAWSUIT REFUSED

Yesterday, November 16, Baku Local Economic Court refused to receive for execution a lawsuit filed by former Azerbaijan State Oil Academy (ASOA) student Elmin Badalov, who is seeking to bring legal action against ASOA for his expulsion from the Academy.

Elmin Badalov was dismissed from State Oil Academy on January 19 2010. On November 12 2009 Bedelov published an article titled “Reportage from Azerbaijan State Oil Academy”, detailed incidents of bribery and financial fraud in the Azerbaijan State Oil Academy. The article was published on the pia.az website. The student journalist claims that the harassment he faced and his failures at the university are related to his articles. He filed a lawsuit with Nasimi District Court, which was rejected on April 5 2010. On July 2 2010, the Baku Appeals Court upheld this decision. On November 23, the Supreme Court upheld the Appeals Court decision.  On February 2 2011, the Nasimi District Court rejected Badalov’s second lawsuit against Azerbaijan State Oil Academy and rector. On 2 June 2011 the Appeals Court dismissed his appeal.
