SUPREME COURT PARTLY FULFILLS YENI MUSAVAT’S APPEAL

On 15 March, Supreme Court heard the appeal of Yeni Musavat newspaper against the decision issued by Baku Appeals Court on 22 October, 2010 against “Azerigas” Production Union Chief Akber Hajiyev, on his failure to respond to the information inquiry.

Judge Akif Isgandarov presided over the hearing. The Judge partially granted the appeal, reported Yeni Musavat newspaper lawyer Vagif Huseyn.  According to Vagif Huseyn, Supreme Court issued a decision to partially fulfill the appeal, to annul Baku Appeals Court’s decision and to transfer the case to this court again for consideration.  BACKGROUND  In the information appeal addressed to “Azerigas” Production Union Chief Ekber Hajiyev, Yeni Musavat newspaper requested information regarding the amount of annual gas consumption and the payment of fees for 2007-2008 by marriage offices. The information inquiry was ignored. Yeni Musavat appealed to Khatai District Court.  Khatai District Court ruled to reject the lawsuit on 21 April, 2010.  Then the Baku Appeal Court issued a decision to uphold the decision on 22 October, 2010.  Yeni Musavat newspaper has been published since 1989 and operates as daily newspaper and has large circulation.
