The ECHR is preparing a decision on the Nardaran case

The European Court of Human Rights (ECHR) will soon announce three decisions on 10 applications from Azerbaijan, including the Nardaran case, the head of the Group for Monitoring the Decisions of the ECHR Khalid Agaliyev. According to him, these cases contain complaints of torture, ill-treatment, unfair trial, violation of property, etc.

In the case of Jabbar Jabbarov and others v. Azerbaijan, the applicants are convicted in the so-called Nardaran case. They were arrested during a special police operation in November 2015 in the Baku suburb of Nardaran. Then the leader of the Muslim Unity Movement Tale Bagirzade and his supporters were detained. All applicants complain of ill-treatment during arrest and detention, and being forced to confess.

In Ilgar Rzayev v. Azerbaijan, the applicant is a member of the Open Society Party who worked for a real estate firm.

In April 2012, at a rally of the opposition movement “Public Chamber”, Rzayev’s mother spoke with anti-government slogans and called the head of state “a corrupt official and a dictator.” A few days later the applicant was arrested and taken to the Drug Control Department of the Ministry of the Interior and charged with heroin possession. During a search of the apartment, heroin was also found and he was sentenced to 2 years in prison.

The applicant complains of a violation of the right to a fair trial and the right to an effective remedy (Articles 6 and 14 of the European Convention. In the case of Zohra Hajiyeva v. Azerbaijan, the issue of violation of property rights is raised. The applicant’s property was expropriated for public use. “She was compensated, but without the required 20% surcharge.
