M. le Président
En vue de votre prochaine entrevue avec le Président de la République d’Azerbaïdjan , M. Ilham Aliyev, il nous parait impérieux d’attirer votre attention sur un certain nombre de points.
Cette démarche est inspirée par le respect que votre pays professe à l’égard des droits de l’homme, à la création desquels, il a largement contribué en proclamant la Déclaration des Droits de l’Homme et du Citoyen en 1789. Depuis cette date, la France, a maintenu son attachement à ce socle fondateur et l’article 11 de cette déclaration a été repris dans les textes de loi de 1881 pour affirmer les droits d’une presse libre et indépendante.
En tant qu’organisation militant pour les droits des journalistes et pour le droit fondamental à la liberté d’expression, l’IRFS ne peut que faire le constat malheureux, que cette presse libre et indépendante est impossible en Azerbaïdjan.
Le régime d’Ilham Aliyev réprime durement toute prise de position ayant le moindre caractère contestataire, ainsi qu’en atteste la récente condamnation du jeune blogueur, Mehman Huseynov. Cette condamnation a d’ailleurs hautement interpellé les instances européennes, puisqu’au siège du Conseil européen, elle alimente “des interrogations légitimes quant au respect de la liberté d’expression et du processus démocratique”.
Ce n’est d’ailleurs pas là, loin s’en faut, la seule condamnation arbitraire à l’encontre d’une personnalité publique exprimant ses opinions politiques. Vous avez déjà eu la grande bonté d’assister la journaliste politique Leyla Yunus qui fut d’abord emprisonnée puis contrainte à l’exil.
Il est estimé qu’en Azerbaïdjan150 prisonniers politiques sont détenus et font face à de longues peines de détention pour des charges aussi ridicules et infondées, que du racket ou du vandalisme.
C’est au vu de la gravité de la situation et de la nature profonde du régime d’Ilham Aliyev que nous faisons appel à vous. Celui-ci est en effet incapable de tolérer les critiques internes et ne cède que devant les pressions extérieures qui s’élèvent contre cette politique de répression.
La France étant un des membres fondateurs du Conseil de l’Europe, elle ne peut manquer de réagir à des atteintes aussi délibérées contre les principes fondateurs qui constituent les sociétés démocratiques modernes. Et ce, surtout pas quand ils sont commis par d’autres membres du Conseil de l’Europe, et qu’ils constituent là une violation non seulement des principes de l’organisation mais également de ses traités fondateurs.
En conclusion, nous tenions à saluer votre courageuse décision de ne pas vous représenter pour un second mandat présidentiel. Malgré votre désir de continuer à servir votre pays, vous avez donné priorité à ce que vous estimiez être le sentiment populaire et ce, sans même qu’il lui ait été donné corps.
On ne peut que souhaiter que les pouvoirs en place en Azerbaïdjan s’inspirent de cette façon d’exercer le pouvoir, comme un réel mandat populaire. Au lieu de cela, le même personnel politique s’active et prospère depuis l’indépendance du pays et veille férocement au maintien de cet état de fait.

Dear President Hollande,
As you prepare for your meeting with Azerbaijani President Ilham Aliyev we would like to call a few points to your attention and ask you to stand up for the basic human rights that your government was instrumental in creating the basis of nearly 228 years ago with the Declaration of the Rights of Man and of the Citizen in 1789. This document is still held in high regard in France today and you have improved and strengthened your commitment to human rights since then. Article 11 of the Rights of Man was expanded on in the press law of 1881 to support the rights of journalists.
The Institute for Reporters Freedom and Safety (IRFS) is an organisation committed to promoting accountable journalism and freedom of expression. Aliyev’s regime seems to only respond to political or financial pressure from the outside. The 3 March shocking fraudulent conviction of the IRFS Chairman, leading blogger Mehman Huseynov to a two-year prison term should be the last call for Azerbaijan’s partners to respond harshly to Baku’s repression. According to the European Union the sentencing of Mehman Huseynov “raises serious questions both as regards respect for freedom of expression and due process of law”.
This regime forces political critics into exile or behind bars as you know from your support of Leyla Yunis who was both imprisoned and is now in exile. The people of Azerbaijan need support from leaders like you who can hold this regime to account through political and financial pressure. France has a much more prolific history of supporting human rights and we call on you to condemn the Azerbaijani authorities and government for imprisoning approximately 150 political prisoners on ridiculous charges such as racketeering and hooliganism. Many of the recent arrests come right after the political critics had been hacked which points to further violations of freedom of expression by the regime.
As one of the founders of the Council of Europe, France should take a tougher line with member states that fail to fulfill obligations. If member states are allowed to get away with blatant violations and fail to comply with the Council of Europe’s rules and treaties, just like Azerbaijan does, the organisation, as such, loses both respect and influence.
We would like to show our deep respect for your decision not to run for a second term as president. You have thoughtfully taken the will of the people into consideration and despite your desire to work hard for them you decided that they know best. This type of selflessness in politics is unheard of in Azerbaijan. The same people have been in power since we gained independence and they manipulate the constitution and elections to ensure that they maintain power.
Thank you for your attention to this important matter. We hope that we can count on your principled position at this critical juncture.

Sizin Azərbaycan prezidenti İlham Əliyevlə görüşə hazırlaşdığınız bir vaxtda, biz sizin diqqətinizə bir neçə məqamı çatdırmaq və sizdən sizin hökumətinizin də 228 il bundan öncə, 1789-cu il tarixli İnsan və Vətəndaş Hüquqları Bəyannaməsi ilə təməlinin yaradılmasında mühüm rol oynadığı əsas insan hüquqlarının müdafiəsinə qalxmağınızı xahiş etmək istərdik. Bu Bəyannamə bu gün də Fransada yüksək dəyərləndirilir və qeyd olunan vaxtdan bəri siz insan hüquqlarına sədaqətinizi daha da inkişaf etdirmiş və gücləndirmişsiniz. İnsan Hüquqları Bəyannaməsinin 11-ci maddəsi jurnalistlərin hüquqlarını dəstəkləmək məqsədi ilə 1881-ci il tarixli mətbuat haqqında qanunda daha da genişləndirilib.
Reportyorların Azadlıq və Təhlükəsizlik İnstitutu (RATİ) məsuliyyətli jurnalistika və ifadə azadlığının təşviqi ilə məşğul olan bir təşkilatdır. Görünür ki, Əliyev rejimi yalnız xaricdən gələn siyasi və maliyyə təzyiqlərinə reaksiya verir. Martın 3-də RATİ sədri, aparıcı blogger Mehman Hüseynovun saxta ittihamla iki il müddətə azadlıqdan məhrum edilməsi Azərbaycanın tərəfdaşlarına rəsmi Bakının apardığı repressiyaya sərt reaksiya göstərməsi üçün son çağırış olmalıdır. Avropa Birliyi hesab edir ki, Mehman Hüseynovun məhkum edilməsi “həm ifadə azadlığı, həm də ədalət mühakiməsinin təmin olunması baxımından ciddi suallar doğurur”.
Azadlıqdan məhrum olunmuş, hazırda isə mühacirətdə olan Leyla Yunusa dəstək verdiyiniz vaxtdan sizə bəlli olduğu kimi, bu rejim siyasi tənqidçiləri ya mühacirətə ya da dəmir barmaqlıqlar arxasına göndərir. Azərbaycan xalqının rejimi siyasi və maliyyə təzyiqləri ilə məsul tuta biləcək sizin kimi liderlərin dəstəyinə ehtiyacı var. Fransa insan hüquqlarına dəstək baxımından zəngin tarixə malikdir və biz sizi Azərbaycan hakimiyyətini və hökumətini 150-ə yaxın siyasi məhbusu reketlik və xuliqanlıq kimi gülünc ittihamlarla həbs etdiyinə görə qınamağa çağırırıq. Son həbslərdən bir çoxu siyasi tənqidçilərin haker hücumuna məruz qalmasından dərhal sonraya təsadüf edir ki, bu da ifadə azadlığının rejim tərəfindən daha bir pozuntusunun göstəricisidir.
Avropa Şurasının qurucularından biri kimi, Fransa öz öhdəliklərini yerinə yetirməyən üzv dövlətlərə qarşı daha sərt xətt götürməlidir. Azərbaycan kimi üzv dövlətlərin kobud hüquq pozuntularına və Avropa Şurasının qaydaları və müqavilələrinə əməl etməməsinə göz yumularsa, təşkilat bununla öz hörmət və nüfuzunu itirər.
Biz sizin ikinci müddətə prezident seçkilərinə qatılmamaq qərarınıza dərin hörmətimizi bildirmək istərdik. Siz xalqın iradəsini nəzərə alaraq, onların mənafeyi üçün səylə çalışmaq arzunuza baxmayaraq, ən yaxşı fikrin xalqın fikri olduğunu qət etdiniz. Siyasətdə bu cür fədakarlıq Azərbaycanda görülməyib. Biz müstəqillik qazanandan bəri eyni insanlar hakimiyyətdə olublar və həmin adamlar hakimiyyətdə qalmaq üçün konstitusiya və seçkiləri manipulyasiya edirlər.
Bu vacib məsələyə diqqətinizə görə sizə təşəkkür edirəm. Biz inanırıq ki, bu cür kritik vəziyyətdə sizin prinsipial mövqeyinizə güvənə bilərik.
