Yesterday, 31 March, in the Baku Economic Court #1, under the chairmanship of Judge Tahira Asadova, a hearing was conducted on the lawsuit of Gundalik Baki newspaper against Press Council Chairman Aflatun Amashov.
The plaintiff, Gundalik Baki newspaper editor-in-chief Habil Valiyev, and the newspaper’s lawyer Zaur Ibadov took part in the hearing. On behalf of the defendant Press Council Representative Shamsaddin Aliyev took part in the hearing.
Lawyer Ibadov filed a motion to adopt a decision to make out a list of properties of the Press Council and issue an arrest on these properties, and impose a ban on the defendants’ actions against the plaintiff until the hearing is over.
The defendant’s representative S.Aliyev said that this motion was unfounded and asked the court to reject it.
After deliberation, Judge T.Asadova said that the motion was not fulfilled.
The plaintiff’s lawyer Z.Ibadov demanded that the protocol of the meeting during which Gundalik Baki newspaper was announced a “racketeering press” be submitted to the court.
The defendant’s lawyer S.Aliyev said he refused to submit the protocol.
Judge T.Asadova scheduled the next hearing for 2 April at 5:00 p.m.
On 30 December, 2009 the Press Council issued a decision to include Gundalik Baki newspaper on list of “racketeering press”. The newspaper leadership filed a lawsuit seeking for a publication of a refutation regarding the decision and to pay 100.000 AZN for moral damages and 50.000 AZN for material damages.
